1. Acceptance of these terms
By creating an account or using the Canopy mobile app or this website (together, the "Service"), you agree to these Terms and Conditions and to our Privacy Policy. If you do not agree, please do not use the Service.
2. The service
Canopy is a care journal for the houseplants you already have. You photograph a plant, the app identifies it and writes a care guide; it keeps track of which room or spot each plant lives in and how well that spot suits it; your phone reminds you when each plant needs water; photo health checks tell you how a plant is doing and what to change; and a cat-safety rating travels with every plant. We may add, change or remove features as the app evolves, and we will tell you in the app about changes that matter.
3. Your account
You need an account to use Canopy. You sign in with Google or (on iPhone) with Apple; there is no separate Canopy password. You are responsible for keeping that Google or Apple account safe and for everything that happens under your Canopy account. Please use one account per person.
You must be at least 16 years old to create an account.
4. The AI features
Identification, care guides and health checks are produced by an AI vision model (see the Privacy Policy for what is sent and to whom). They are helpful, but they are not infallible:
- An identification can be wrong, especially from a single photo or a poor one. The app shows its confidence and lets you choose or type the right plant; check anything you are unsure about.
- Care guides and health-check advice are general guidance generated by a computer model. They are not professional horticultural advice, and following them does not guarantee a plant will thrive.
- The cat-safety rating is deliberately cautious: when the model is not sure a plant is safe it says "unknown", and the app treats unknown as unsafe. It is still not a guarantee and it is not veterinary advice. If you think an animal has eaten part of a plant, contact a veterinarian.
To keep the Service affordable for everyone, the AI features have daily limits: currently 30 identifications or care-guide lookups and 20 health checks per account per rolling 24 hours. We may change these limits.
5. Acceptable use
You agree not to misuse the Service. In particular, you will not:
- Use the Service for any unlawful purpose.
- Try to access our systems, another person's account or another person's data without permission.
- Interfere with or disrupt the Service, or try to get around its limits (for example by automating requests to the AI features).
- Upload photos you do not have the right to use, or photos that show other people without their agreement. Canopy is for photos of plants.
- Reverse-engineer the app or resell access to it.
6. Price
Canopy is free to download and use. There are no in-app purchases, subscriptions or advertisements. If we ever introduce a paid option, we will say so clearly in the app and in these terms before anything is charged.
7. Your content
Your photos, plant names, notes and care log are yours. By using the Service you give us the limited permission we need to store them, back them up, show them back to you, and send the relevant parts to our AI provider in order to identify a plant, write its care guide or check its health. That is the whole of it: we do not publish your content, share it with other users or use it to train AI models. Nothing you put into Canopy is visible to anyone else, and you can delete any plant, or your whole account, at any time.
8. Intellectual property
The Service, including its design, code, name and branding, belongs to Kealy Studio and is protected by intellectual-property law. These terms do not give you any rights to our trademarks or branding. The care guides and health-check text generated for your plants are yours to use for looking after them.
9. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, express or implied. We do not promise that it will be uninterrupted or error-free, that reminders will always fire (your phone's settings, battery optimisation and notification permission are outside our control), or that the AI's identifications, care advice or cat-safety ratings will be correct. Canopy is not a substitute for advice from a horticulturist or a veterinarian, and you remain responsible for your plants and your pets.
10. Limitation of liability
To the fullest extent permitted by law, Kealy Studio will not be liable for any indirect, incidental, special or consequential loss arising from your use of the Service, including the loss of a plant, harm to a pet, or lost data. Because the Service is free, our total liability for any claim is limited to the greater of €50 or the amount you paid us in the twelve months before the claim arose. Nothing in these terms limits liability that cannot be limited by law.
11. Ending things
You can stop using Canopy at any time and delete your account from inside the app (Settings → Delete account); see the data deletion page. We may suspend or close an account that breaks these terms, with notice where that is reasonably possible, and we may retire the Service with reasonable notice in the app.
12. Governing law
These terms are governed by the laws of Spain, and any dispute will be heard by the courts of Spain. If you are a consumer in the European Union, you also keep the protections of the mandatory consumer law of the country you live in, and you may use the European Commission's online dispute-resolution platform.
13. Changes to these terms
We may update these terms from time to time. When we do, we will change the date at the top of this page and, for significant changes, tell you in the app. Continuing to use the Service after a change takes effect means you accept the updated terms.
